Withdrawal from the contract

If

A) you are a consumer
Or

B) you are an individual, and the contract you entered into with us after December 31, 2020, is directly related to your business activities, but does not have a professional character for you

as a rule, you have the right to withdraw from the remote contract.

You can withdraw from the contract by submitting to us a statement of withdrawal from the contract, e.g., via an email sent to the address: sklep@e-toll.org.pl

Please return the item to us promptly to the address: ul. Przemysłowa 39a, 33-100 Tarnów, but no later than 14 days from the day you withdrew from the contract.

You can withdraw from the contract within 14 days.

The start of the fourteen-day period for withdrawing from the contract begins: for a contract in which we deliver an item, being obliged to transfer its ownership – from taking possession of the item by you or a third party indicated by you other than the carrier, and in the case of a contract that includes several items that are delivered separately, in batches, or in parts – from taking possession of the last item, batch, or part by you or a third party indicated by you other than the carrier. To meet the deadline, it is enough to send the statement before its expiration.

Payments made by you, including the cost of delivering the goods based on the terms specified in the regulations, will be refunded to you immediately, but no later than 14 days from the day we receive your declaration of withdrawal from the contract.

We may withhold the refund of the payment received from you until we receive the item back or you provide proof of its return, depending on which event occurs first.

Remember that the right to withdraw from a distance contract does not apply to you, among others, in relation to the contract:

  • in which the subject of the service is a non-prefabricated item, produced according to your specification or serving to satisfy your individualized needs;
  • in which the subject of the service is a product that deteriorates quickly or has a short shelf life;
  • in which the subject of the service is an item delivered in a sealed package, which cannot be returned for health protection or hygiene reasons if the packaging has been opened after delivery;
  • in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the packaging has been opened after delivery.

Complaints

If the product you purchased from us turns out to be defective, you have the right to file a complaint based on the warranty. It is best to submit a complaint to the e-mail address: sklep@e-toll.org.pl or by postal mail to ul. Przemysłowa 39a, 33-100 Tarnów.

If you are not a consumer, we are liable to you, within the limits allowed by law, only up to the amount of the order you placed, within a year from the delivery of the goods. The following provisions apply to consumers.

The defective product should be sent to the address: ul. Przemysłowa 39a, 33-100 Tarnów.

In relation to the defect, you can request:

  • Replacement of the item with one free of defects,
  • Removal of the defect,

or make a declaration about:

  • Price reduction,
  • Withdrawal from the contract – in the case of a significant defect.

We are liable for defects found within two years from the date of product delivery.

As a rule, you can report a defect within a year of noticing the defect, but the time for filing a complaint cannot end before the expiration of the seller’s liability period.

Your complaint will be addressed and reviewed within 14 days from the date we receive your complaint notification.
